Consultation on local authority land transfer

The Department has launched a consultation with local authorities on regulations so that local authority land can be transferred more quickly when a maintained school becomes an academy. The consultation will run for ten weeks from the 9th November 2011 until 18 January 2012.

Background

When a maintained school become an academy their land is transferred, under lease, to the new academy’s trust. These new regulations enable the Secretary of State to get the required information for that transfer from local authorities. They do not give him any new powers to force local authorities to transfer land, or remove any rights from local authorities.
